Terms & Conditions

1. GENERAL PROVISIONS AND LEGAL INFORMATION The website www.gemcollagen.com is operated by FRUZZION SRL (BE0720811948), located at 150 Chaussée de la Hulpe, 1170 Watermael-Boitsfort, Belgium. Acceptance of these Terms is absolute and excludes any other documents. The Consumer declares to be of legal age and possesses the full legal capacity to enter into this agreement.
 

2. PRODUCTS, PRICES, AND TERMS

  • Characteristics: Essential characteristics of our functional beverages are described on each product page.

  • Prices: Prices are indicated in Euros (€) inclusive of all taxes (VAT included), excluding delivery costs.

  • Modification: GEM reserves the right to modify prices at any time; products will be billed based on rates in effect at the exact time the order is validated.
     

3. MEDICAL AND HEALTH DISCLAIMER (STRICT)

  • Nature: GEM products are functional beverages formulated with marine collagen and vitamins. These are functional beverages, not medications, and are not intended to diagnose, treat, cure, or prevent any disease.

  • Channels: All information on our website, social media, or packaging is for informational purposes only and is not a substitute for professional medical advice.

  • Consultation: If you are pregnant, nursing, taking medication, or have a specific medical condition, you must consult your physician before consumption.

  • MAJOR ALLERGEN WARNING: Our beverages contain MARINE COLLAGEN (FISH).

  • Liability: GEM cannot be held liable for adverse reactions related to individual sensitivities or failure to verify the ingredient list prior to consumption.
     

4. SUBSCRIPTION SYSTEM AND CANCELLATION

  • Principle: Open-ended contract with automatic recurring payments.

  • Cancellation: Possible at any time via the account or at info@gemcollagen.com. The email timestamp shall prevail.

  • Current Cycle: Any month already billed is due and will be delivered; no pro-rata refunds are permitted. Disputes do not constitute a reason to suspend payment.

5. PAYMENT AND SERVICE INTERRUPTIONS

  • Payment: Payment is due immediately upon ordering via certified providers. GEM does not store any credit card information.

  • Failure: GEM reserves the right to apply 1% monthly late interest and a 10% administrative fee for late payments.

  • Service: FRUZZION SRL is exempt from liability for technical interruptions, maintenance, or force majeure.

6. DELIVERY AND COMPLAINTS

  • Zone: Belgium only. Carrier "Delivered" status constitutes proof of receipt. Risk transfer occurs upon delivery to the carrier.

  • Timeframes: Processing within 1 to 3 business days. Delivery times are indicative only.

  • Damages: Report damaged products with photos within 48 hours to info@gemcollagen.com.

7. WITHDRAWAL, HYGIENE, AND DISPUTES

  • Deadline: 14 calendar days for unopened products.

  • HYGIENE EXCEPTION: For health and hygiene reasons, the right of withdrawal is void once the seal or packaging is opened or tampered with. No unsealed or opened products will be refunded.

  • Costs: Return shipping costs are the sole responsibility of the customer.

  • Law & Jurisdiction: Belgian law. Exclusive jurisdiction of the French-speaking courts of Brussels.
